Looks like there's been a breach of Article 6 of the Human Rights Act here - good luck to the couple in their appeal is what I say.
I bet the LA placed the couple in B&B and if they did so, why didn't they refer the neighbour to one of their departments dealing with disrepair? I'm sure that they could have considered a grant for the necessary repairs - or if it was that bad, do the repairs themselves and claim back from the owner.
