Loud music neighbour hit by Asbo (http://www.gazettelive.co.uk/news/teesside-news/2008/11/20/loud-music-neighbour-hit-by-asbo-84229-22301657/)

A NEIGHBOUR from hell who regularly played loud music into the early hours has been hit with an anti-social behaviour order.

Anthony Allan Dixon, 38, has been banned from playing loud music in any property across England and Wales, after he made his neighbours’ lives a misery with his super-sized stash of audio and television equipment.

During a search of his house in Acton Street, central Middlesbrough, environment health officers discovered 26 electrical items - constituting the biggest haul of noise-making equipment ever seized in the town.

Items seized included six televisions, a number of amplifiers, a DVD player, video players and four sets of speakers.

This is the first time that Middlesbrough Council has used an Asbo to combat a noise complaint, but Dixon has now had all his electrical items returned to him.

Middlesbrough Council’s executive member for community protection Councillor Barry Coppinger said: “Of course people have a right to enjoy themselves, but they in turn have a duty to show consideration towards those around them.

“This sort of behaviour of is totally unacceptable to residents and the council, and this case shows we will not hesitate to act to ensure our communities are free from this kind of noise nuisance.

“Any breaches could see the perpetrator facing a lengthy stretch behind bars, which I hope will act as a powerful deterrent.”

Neighbours in the Woodlands Road area of town were plagued by Dixon’s blaring music, which caused walls to vibrate and could often be heard up to 15 houses away.

He had previously been served with a Noise Abatement Notice, but this was breached on four separate occasions. Despite two seizures of his equipment, the problems continued.

Magistrates granted the Asbo earlier this week, and Dixon now faces a fine and a jail term of up to five years if he breaches it.

How to keep the peace
UNDER the terms of the Asbo, Dixon is prohibited from:

Behaving in a manner likely to intimidate, cause harassment, alarm or distress to other people.

Threatening, intimidating or using violence towards Middlesbrough Council employees.

Allowing premises to be used in a way that causes harassment, alarm or distress.

Causing, playing or permitting loud music to be played in any property where he is a tenant or owner in such a manner as to cause harassment, alarm or distress to others.

Causing a nuisance, annoyance or disturbance to anyone living in or visiting Acton Street in Middlesbrough.

Threatening or inflicting violence against anyone living at the same address.
