Noisy neighbour fined £600 for playing music too loud (http://www.nwemail.co.uk/news/1.123941)

A NOISY neighbour has been fined £600.

Neville James Ryland, 19, of Ashworth Street, Dalton, had been playing music too loud.

Furness Magistrates’ Court heard how police and environmental health officer Damon Pearson visited Ryland’s home on six separate occasions between December 2007 and March this year.

Mr Paul O’Donnell, prosecuting for Barrow Borough Council, said: “Mr Pearson was first called to the defendant’s address on December 6 of last year at 10.07pm and recognised the song being played as its loud bass beat was audible from the complainant’s address.”

Ryland had been served a noise abatement notice by the council on September 20 last year for playing loud music.

Mr Pearson was called out to Ryland’s home a further four times and noted similar music being played between the times of 4.40pm and 9.41pm.

On February 7 at 8.08pm, PC Antony Howson was called out to Ryland’s address and had to knock repeatedly on the door before he answered. PC Howson informed Ryland of the complaint and he agreed to turn down the music.

Ryland was found guilty in his absence of six counts of contravening or failing to comply with an abatement notice served by the local authority concerning a statutory nuisance.

He was ordered to pay a £600 fine, £300 costs and a £15 victim surcharge.

Failure to comply with a noise abatement notice can result in the seizure of equipment. But no such application was made.

Stereos and speakers should come with a warning sticker indicating the potential fines for playing the music too loud.
